1. About The Program

The Marley & Max Affiliate Program allows approved affiliates to promote Marley & Max products and services in exchange for referral commissions on qualifying sales.

Marley & Max reserves the right to approve, reject or remove affiliate accounts at its sole discretion.

2. Eligibility

To participate in the Affiliate Program:

• You must be at least 18 years old
• You must reside in South Africa or another approved jurisdiction
• You must provide accurate registration information
• You may not create multiple affiliate accounts without permission
• You may not use automated systems or bots to participate in the program

3. Affiliate Links & Promotion

Approved affiliates will receive unique referral links or codes used to track qualifying purchases.

Affiliates may promote Marley & Max using websites, blogs, social media, email marketing or other lawful methods provided such marketing:

• Is truthful and not misleading
• Does not make false medical claims
• Complies with South African advertising laws
• Does not damage the Marley & Max brand
• Does not contain spam, illegal or offensive content

Affiliates may not represent themselves as employees, partners or official representatives of Marley & Max.

4. Commissions

Referral commissions are only payable on successfully tracked and completed purchases made through valid affiliate links or referral systems approved by Marley & Max.

Marley & Max reserves the right to withhold or reverse commissions relating to:

• Fraudulent activity
• Self-referrals
• Chargebacks or refunded purchases
• Spam or unlawful marketing practices
• Manipulation of tracking systems

5. Payments

Affiliate payouts may be processed monthly provided the affiliate has reached the minimum payout threshold determined by Marley & Max.

Marley & Max reserves the right to modify commission structures, payout schedules or minimum thresholds with reasonable notice.

6. Affiliate Responsibilities

Affiliates are solely responsible for:

• The operation and content of their own platforms
• Compliance with applicable laws and regulations
• The accuracy of promotional content
• Maintaining account security
• Ensuring marketing content does not infringe third-party rights

7. Prohibited Conduct

Affiliates may not:

• Use spam or unsolicited marketing
• Make misleading or deceptive claims
• Bid on Marley & Max trademarked terms in paid advertising without permission
• Use affiliate links for personal purchases
• Promote illegal activities or unlawful cannabis use

8. Intellectual Property

Marley & Max grants affiliates a limited, non-exclusive, revocable right to use approved logos, banners and marketing materials solely for participation in the Affiliate Program.

All Marley & Max branding and intellectual property remain the property of Marley & Max.

9. Termination

Marley & Max may suspend or terminate affiliate accounts at any time where these Terms are breached or where conduct is deemed harmful to the brand.

Upon termination, affiliates must immediately remove all Marley & Max branding, affiliate links and promotional materials.

10. Limitation of Liability

Marley & Max shall not be liable for indirect, incidental or consequential damages arising from participation in the Affiliate Program, including loss of profits, data or business opportunities.

11. Compliance With South African Law

Affiliates agree to comply with all applicable South African legislation including:

• Consumer Protection Act 68 of 2008
• Protection of Personal Information Act 4 of 2013 (“POPIA”)
• Electronic Communications and Transactions Act 25 of 2002 (“ECTA”)
• Applicable advertising and cannabis-related regulations

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from the Affiliate Program shall fall under the jurisdiction of the South African courts.

13. Amendments

Marley & Max reserves the right to amend these Terms at any time. Continued participation in the Affiliate Program constitutes acceptance of any updated Terms.
